Terms of Use

1. Acceptance

The OOMU Marketplace (the "Marketplace") is operated by Eldris ("Eldris," "we," "us," or "our"). By accessing or using the Marketplace, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Marketplace.

2. Accounts and eligibility

You must provide accurate information when creating an account and keep it up to date. You are responsible for activity under your account and for keeping your password secure. You must be at least 16 years old, or the age of majority in your jurisdiction, to use the Marketplace.

3. The developer program

Publishing mods requires acceptance into the developer program. We review applications and may approve or decline them at our discretion. Every mod and every new version is reviewed before it becomes available, and we may reject, delist, or remove any submission that breaks these terms or our published mod guidelines.

Your content, your ownership. You keep ownership of the mods you submit. By submitting a mod, you grant Eldris a non-exclusive, worldwide license to host, review, display, distribute, and deliver it to users through the Marketplace, and to store it for the purposes of operating the Marketplace. You represent that you have the rights to everything you upload and that it does not infringe anyone else's rights or violate any law.

Prohibited content. Mods must not contain malware, hidden telemetry, credential harvesting, undisclosed network or file access, or anything that escapes OOMU's privacy sandbox, and must not be unlawful, deceptive, or infringing. This is in addition to the standards in the mod guidelines.

4. Pricing, payments, and payouts

Mods may be free or priced between $1 and $500. Payments and developer payouts are processed by Stripe, and your use of Stripe is subject to the Stripe Connected Account Agreement and Stripe's terms. For each paid sale, the developer receives 85% and the Marketplace retains a 15% platform fee to fund review, hosting, and operations. You are responsible for any taxes on your earnings. Prices are shown in US dollars.

5. Purchases, licenses, and refunds

Buying a paid mod grants you a personal license to download and use that mod under any license terms the developer includes with it. Because mods are digital goods delivered immediately, purchases are generally final; if a mod is materially broken or misrepresented, contact support@oomu.io and we will review the situation and may issue a refund at our discretion.

6. Open-source software

OOMU itself is distributed separately from the Marketplace. Your use of that software is governed by the license included in its source repository, not by these Terms. Individual mods may carry their own licenses, which govern your use of those mods.

7. Acceptable use

You agree not to misuse the Marketplace, including attempting to disrupt or compromise it, accessing it through unauthorized means, scraping it unlawfully, circumventing review or payment, or using it to violate any law or the rights of others.

8. Suspension and termination

We may suspend or ban an account, and delist its mods, if it violates these terms or the mod guidelines, or to protect users and the Marketplace. You may stop using the Marketplace and close your account at any time. Some provisions, including intellectual-property, payment-record, disclaimer, and liability terms, survive termination.

9. Intellectual property and trademarks

The Marketplace's design, text, graphics, and the OOMU name and logo are owned by or licensed to Eldris and are protected by intellectual-property laws. OOMU® is a registered trademark of Eldris. You may not copy, reproduce, or use our content or trademarks without our prior written permission, except as allowed by these terms or by law. Mods and their content belong to their developers.

10. Third-party services

The Marketplace relies on and links to third-party services, including Stripe and Google. We do not control them and are not responsible for their content or practices. Your use of those services is governed by their own terms.

11. Disclaimers

The Marketplace is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. Mods are created by third-party developers; we review them but do not warrant that any mod will meet your needs or be error-free. We do not warrant that the Marketplace will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Eldris will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the Marketplace or any mod.

13. Governing law

These Terms are governed by the laws of the United States and the state in which Eldris is established, without regard to conflict-of-law principles. You agree that any dispute relating to the Marketplace will be subject to that governing law.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will change the effective date above. Your continued use of the Marketplace after a change means you accept the updated Terms.
